Femi Falana (SAN) speaks on the chances of Peter Obi’s lawyers upturning the presidential election result in Court

Amid ongoing reports that the Labour Party (LP) presidential candidate, Peter Gregory Obi has dragged President-elect, Asiwaju Bola Ahmed Tinubu to the Elections Tribunal sitting in Abuja, reactions have begun trailing as a Senior Advocate of Nigeria (SAN) and human rights activist, Femi Falana has come out to allege that the Labour Party’s Presidential Candidate Lawyers have an upper hand heading into the court.

However, he stated that what the Court will look at is the evidence presented by the petitioners and the veracity of such evidence. He cited the fact that the Independent National Electoral Commission (INEC) has also admitted that some electoral officers have breached the electoral commission’s conduct.

Speaking further, Femi Falana also identified that this substantial evidence being submitted in court could lead to the annulment of the election that produced Bola Tinubu as President-elect.

Moreover, he disclosed that the court’s submission will be strictly based on the evidence presented by the petitioners against the February 25th election outcome.

Quoting the exact statement released by Femi Falana, he said, ”INEC has acknowledged that there were challenges with respect to the deployment of technology and the conduct of electoral officers. INEC had promised Nigerians that electoral officers who abuse their offices would be brought to book. And I will say that Peter Obi lawyers can invoke the electoral act provision to tackle INEC.

In addition, he stated, “The same applies to other petitioners. Because the court and the tribunal are empowered to recommend the prosecution of those who manipulated the elections, inflated figures, and betrayed the electorate’s confidence. If such evidence is presented, the court is empowered to recommend the prosecution of anyone indicted.”
