Taste of their own medicine! Brexiteer hits Remainers with his OWN legal challenge

TORY MP Daniel Kawczynski is plotting to hit back at Remainers trying to block a no deal Brexit in a legal move which will inevitably draw comparisons to Gina Miller’s successful court case last week.

Businesswoman Ms Miller was one of a number of parties who challenged Prime Minister Boris Johnson’s prorogation of Parliament, with the Supreme Court finally ruling last week the suspension was unlawful. However, Brexiteer Mr Kawczynski – MP for Shrewsbury and Atcham – revealed he was drawing up plans of his own targeting the Benn Act, which would force Mr Johnson to ask the EU for an extension to Article 50 if no deal has been agreed by October 19.

Mr Kawczynski tweeted: “The rule of law must be respected.

“I am in discussions with an established London law firm and 2 senior barristers with a view to challenging Benn Act through Courts.

“We must not allow our opponents to bind the hands of PM as he negotiates with overseas power.”

Mr Kawczynski's move could be seen as a riposte to Remainers such as Gina Miller

Speaking about Mr Johnson himself, Mr Kawczynski told Express.co.uk all the efforts to derail Brexit and discredit the PM were motivated by fear of him actually succeeding.

He said: “Somebody like him comes along once in a generation.

“The quality of leadership we have had in recent years is very low.

“The last time we had a really good leader was Margaret Thatcher in 1990 – that’s 30 years ago.

“The British people are working out what’s going on at Westminster I think.

“Boris Johnson is the only one who has the gumption and the sheer bloody-mindedness to get this done.

Boris Johnson is out of step with siblings Rachel and Jo on Brexit 

“He is like that lager – he reaches the parts of the electorate other politicians don’t reach.

“So of course he is a threat to the liberal elites of this country.”

The Times has reported that Mr Johnson’s plan to get around the Benn Act – the law aimed at preventing a no-deal Brexit without MPs’ approval – would be to ask EU leaders to rule out any extension to the October 31 deadline.

Mr Johnson denied that was the case in an interview with the BBC.

He added: “In truth, we have not made any such request.”

However, he did appear to question whether the Benn Act had been drawn up in collaboration with other EU states following claims from Downing Street sources of “collusion with foreign powers”.

There was a “legitimate question” to be asked about how the legislation came about, he said.

Mr Johnson dismissed as “absolute nonsense” a suggestion by his sister that his Brexit strategy could be being driven by the Prime Minister’s hedge fund backers.

Rachel Johnson claimed last week that the tactics “could be from – who knows – people who have invested billions in shorting the pound in the expectation of a no-deal Brexit”.
